Peru Tightens Traffic Penalties for Violations During States of Emergency

It takes effect in five days to give authorities clearer tools to restrict circulation during emergencies.

Overview

  • The Executive published Supreme Decree No. 002-2026-MTC in El Peruano, with the changes entering into force five calendar days after publication.
  • Infraction M41 is redefined for disasters or natural emergencies with a 1.5 UIT fine, 50 license points, vehicle removal, and joint liability for transport operators when applicable.
  • For internal-order emergencies, M41 sets a 12% UIT fine and 50 points for a first offense and a 24% UIT fine and 60 points for repeat violations, maintaining transporter joint liability.
  • Article 336 preserves voluntary-payment discounts—17% within the first five working days and 33% from day six until before the sanction resolution—while excluding certain serious and repeat offenses, including repeat M41.
  • New Article 140-B authorizes emergency declarations to impose specific transit and vehicle-use limits, and the MTC reports that penalties under the revised scheme can reach up to S/1,320.
