Overview
- Congress formalized the internal regulations for a restored bicameral legislature through resolutions published in El Peruano, including RL 005-2025-2026-CR for the Chamber of Deputies and RL 006-2025-2026-CR for the Senate.
- The Senate is set at a minimum of 60 members for five-year terms, cannot be dissolved, remains in session if the Chamber of Deputies is dissolved, and gains authority to elect or ratify top officials such as the ombudsman, comptroller, Constitutional Court magistrates, three BCRP directors, the BCRP president, and the SBS superintendent.
- The Chamber of Deputies will have at least 130 members for five years with powers to initiate legislation, interpellate and censure ministers, decide confidence votes, and is scheduled to elect its board by July 26, 2026 and be installed on July 27, 2026.
- Both chambers’ rules specify that they take effect the day after the JNE proclaims official results of the 2026 general elections, establishing the framework for installation and operations in July 2026.
- The regulations redefine presidential vacancy by splitting the process between chambers, with initiation and an initial vote in the Chamber of Deputies and a final decision by the Senate, as legislators and legal experts simultaneously signal the incoming Congress may revise these rules.
