Peru Publishes APCI Regulations, Approves New Sanctions for Foreign Aid Oversight

The new rules expand oversight to entities that handle foreign aid to align projects with national development priorities.

Overview

  • Decreto Supremo 032-2025-RE puts the APCI regulation into force, implementing the updated framework set by Law 32301 for managing international cooperation.
  • Decreto Supremo 033-2025-RE creates a new Infringements and Sanctions Regulation that takes effect in 60 days and replaces DS 016-2019-RE.
  • The sanctions regime classifies offenses as minor, serious or very serious with penalties ranging from written warnings to fines of up to 500 UIT, temporary suspensions and cancellation of registrations for repeat very serious violations, including diverting funds or financing litigation against the Peruvian State.
  • The regulation mandates automatic digital registration and ongoing updates for ONGD, ENIEX, IPREDA and a registry of experts and volunteers that includes an ethnic variable, with post-registration audits.
  • APCI gains powers to demand documentation, review files, interview beneficiaries and conduct programmatic, financial and physical verifications, with immediate coordination set with SUNAT and the UIF-SBS to strengthen scrutiny.
