Overview
- Legislative Decree No. 1723, published in El Peruano, establishes identification and traceability rules for calls and SMS that apply to telecom operators and other agents involved in routing.
- Operators must identify the source of communications, block those with irregular numbering or criminal indicators, and deploy user alerts to warn of suspected fraud.
- The measure extends the existing “500” identifier to text messages and modifies Law No. 32323 so spam controls explicitly cover SMS.
- The MTC is empowered to continuously monitor operator networks and the systems of traceability-linked agents while safeguarding the secrecy of communications, with infractions classed from light to very serious and punishable by warnings or fines.
- The ministry must approve a Supreme Decree regulation within 90 days, the obligations take effect the day after its publication, and implementation will be financed from the MTC’s institutional budget.
