Peru Observes Dec. 8–9 Paid Holidays With Triple Pay for Shifts Without Substitute Rest

Workers who cover shifts on those dates without a compensatory day off are entitled to triple pay under current rules.

Overview

  • Both dates are national paid holidays, with Dec. 9 established by Law No. 31381 to honor the Battle of Ayacucho.
  • The rule applies to public and private sectors, with pay calculated as holiday pay plus pay for the worked day plus a 100% surcharge, according to the Lima Chamber of Commerce.
  • Employers may grant a paid substitute rest on another date, which removes the right to the triple-payment surcharge.
  • The Education Ministry indicated that school classes will be suspended nationwide for both dates.
  • Major banks will not offer in‑person service during the holidays, with digital channels operating and Banco de la Nación limiting in‑person service to MACMYPE offices in Lima and Callao during reduced hours.
