Peru Lawmaker Files Constitutional Complaint Against Boluarte Over Matarani Port Extension

The Subcommittee on Constitutional Accusations must decide on admissibility before any case reaches the Attorney General.

Overview

  • Congressman Edwin Martínez filed the complaint targeting former president Dina Boluarte and ex-ministers César Sandoval and Raúl Pérez-Reyes with the congressional subcommittee.
  • The filing alleges the Executive approved Adenda No. 5 through Supreme Decree 015-2025-MTC to add 30 years to TISUR’s Matarani concession without a new public tender.
  • The document cites alleged violations of Articles 58, 61 and 76 of the Constitution, and accuses the officials under Penal Code Articles 384 and 399 for collusion, incompatible negotiation and improper use of office.
  • The petition requests a 10-year ban from public office for those named and a referral of the case to the Office of the Attorney General for potential criminal proceedings.
  • Sources close to the concession process told Perú21 the renewal mechanism is lawful and described the complaint as political, while the subcommittee has not issued a decision.
