Overview
- Indecopi’s competition commission fined 13 companies 100,852.72 UIT—over S/539 million—and sanctioned five executives with an additional 262.67 UIT for colluding in public drug procurements.
- The investigation found coordinated bids and abstentions across tenders from December 2006 to February 2020 for Minsa and EsSalud, supported by coded emails, chat logs and secret meetings.
- Minsa said its Procuraduría filed a criminal complaint on July 25, 2024 and has asked the Public Ministry to re-evaluate and deepen criminal investigations.
- The ministry will seek civil indemnification equal to or greater than the fines, has requested OECE review for procurement sanctions and wants any recovery directed to strengthen the SIS.
- Sanctioned firms have denied coordination and are expected to appeal to Indecopi’s Specialized Chamber by mid‑December, a process that could delay payment and extend litigation.
