Peru Enacts New PPP Law to Unlock $30 Billion and Elevate ProInversión

The MEF has 60 days to issue the regulation that puts the streamlined framework into operation.

Overview

  • Law No. 32441 was published in El Peruano after approval by insistence, establishing a modernized regime for APP and Proyectos en Activos.
  • The MEF projects the reform will enable more than $30 billion in infrastructure and public service projects across multiple sectors.
  • Key provisions reduce timelines for technical studies, streamline project phases and contract modifications, and aim to make processes more predictable.
  • ProInversión is strengthened to act as concedente in new APPs and, by a transitional clause, assumes that role for contracts signed in the past 12 months exceeding 80,000 UIT, covering projects such as Anillo Vial Periférico, the HuancayoHuancavelica railway, and Essalud hospitals in Piura and Chimbote.
  • Oversight inputs from the Comptroller and regulators become non‑binding, while ProInversión targets adjudicating 53 projects totaling about $11.9 billion in 2026 as the MEF drafts the required regulation.
