  • Rospigliosi and Abensur were cited for omissions in their duty to safeguard congressional assets, with the JEE noting their affiliation to Fuerza Popular, while Luza was identified as the direct user of the equipment.
  • The incident occurred on October 30 at Villa Gabuko in Huanchaco, Trujillo, where a Congress-owned camera (inventory code 29459) was used during an event announcing Keiko Fujimori’s presidential bid.
  • Luza admitted using the device and later resigned, but the JEE rejected his claim of an inadvertent mix-up and flagged his conduct as potentially fitting the crime of embezzlement by use under Penal Code Article 387.
  • The JEE exonerated the titular Official Mayor, Giovanni Forno Flórez, due to his documented vacation and formal delegation, and sent the case files to the Public Prosecutor’s Office, the Comptroller General, and Congress.
