Peru Court Orders Pretrial Detention for Three Police Over Desaguadero Vehicle Theft

The ruling sends the sub-officers to pretrial detention pending investigation, with defense appeals filed.

Overview

  • The Desaguadero preliminary investigation court, led by Judge Anselmo Jhonny Puma Quispe, granted the prosecution’s request after finding strong indications of aggravated theft against the officers to the detriment of vehicle owner Fredy Chambilla Condori.
  • Detention terms were set at nine months for SO2 Jhonatan Huirse Silva and six months for SO3 Alfredo Apaza Escarcena and SO3 Luis Alberth Villacorta Condori.
  • The court ordered their internment in a penitentiary designated by INPE, and local reports indicate the three were placed in Yanamayo prison.
  • Prosecutors cite patrol records and security video showing the EPE-433 police unit circling the victim’s home from about 8 p.m. to 3:30 a.m., with the accused assigned to duty from 8 p.m. Dec. 24 to 2 a.m. Dec. 25.
  • The case theory alleges the officers used the patrol to track the target, verified the car’s operation, disabled its security, and enabled an unidentified civilian to take the vehicle toward Moquegua.
