Overview
- Supreme Resolution No. 236-2025-JUS, published today in El Peruano, authorizes Cabrera’s extradition to California to be prosecuted for the alleged murder of Sheylla Lisbet Gutiérrez Rosillo.
- The approval follows an October 6 ruling by the Supreme Court’s Sala Penal Permanente declaring the U.S. request admissible, backed by the Official Commission on Extraditions and Transfer of Convicted Persons.
- Cabrera surrendered to Interpol Lima on August 27, accepted transfer under the simplified procedure the next day, and was placed in nine months of preventive detention for extradition purposes.
- Before the handover, Peru must verify he has no pending proceedings or convictions in the country, and U.S. authorities must guarantee credit for the time he has been detained in Peru.
- The resolution carries the signatures of President José Enrique Jerí Oré and the justice and foreign ministers, as authorities coordinate custody transfer with Interpol and the repatriation of Gutiérrez’s remains.
