Peru Appeals Court Shuts Down Terror-Affiliation Case Against Congressman Guido Bellido

The court found that mere receipt of ideological USB files cannot establish terrorist membership.

Overview

  • The Tercera Sala Penal de Apelaciones Nacional on Jan. 13, 2026 revoked an Aug. 21, 2025 ruling and ordered the investigation definitively archived with respect to Bellido.
  • The panel of judges Enríquez Sumerinde, Magallanes Rodríguez and Mosqueira Cornejo said prosecutors presented no evidence of planning, logistics or propaganda activities by the legislator.
  • The prosecution’s case relied mainly on USB drives with Marxist-Leninist-Maoist content allegedly sent by Florabel Vargas Rojas, known as “camarada Vilma.”
  • The decision nullifies the accusation that linked Bellido to the Militarized Communist Party of Peru, a faction described as associated with Sendero Luminoso in the VRAEM.
  • The ruling pertains only to Bellido, leaving related proceedings against other accused individuals in the broader case to continue separately.
