Overview
- Peru published Decreto Supremo 012-2026-MINCETUR putting the Protocol of Optimization of the 2010 Peru–China FTA into force on November 1, 2026, after ratification by Decreto Supremo 035-2026-RE in July 2026.
- The protocol updates seven existing chapters and adds five new chapters that create dedicated rules for e-commerce, competition, global supply chains, customs cooperation, standards and the environment.
- Practical changes include updated rules of origin, streamlined sanitary and phytosanitary procedures, mutual recognition and interconnection of certificates, and customs facilitation intended to cut paperwork and transport delays for exporters.
- Officials say the update targets broader export opportunities for MiPymes and non-mining sectors while preserving the original FTA framework and strengthening the investment framework between the two countries.
- China is Peru’s largest trading partner, accounting for roughly 35% of trade and more than US$32 billion in Peruvian exports in 2025, and authorities expect the protocol to help diversify exports beyond minerals into agriculture, fisheries, manufacturing and tech-related products.
