Parents of Evergreen High School Shooter Will Not Face Charges, Investigators Say

Detectives found no probable cause after determining the .38-caliber revolver was a locked family heirloom with no parental DNA on it.

Overview

  • The Jefferson County Sheriff's Office closed the case Wednesday after a nearly five-month investigation, pending any new evidence.
  • Investigators identified the weapon as a Smith & Wesson .38 Special first purchased in Florida in 1966 and traced its ownership with help from the FBI and ATF.
  • A letter from the family's attorney said the revolver belonged to a grandparent and was kept out of sight in a large locked safe.
  • DNA testing found no link between the parents and the firearm, and investigators said they could not meet the elements to pursue charges under transfer or secure-storage laws.
  • The Sept. 10, 2025 shooting wounded a 14-year-old student and 18-year-old Matthew Silverstone, and community support remains available through the Evergreen Resiliency Center.
