Otay Mesa Border Shooting Suspect Charged as CBP Officers’ Identities Are Released

San Diego Police opened an external county-protocol probe; HSI launched a criminal case against the driver; an administrative review of the officers’ use of force is underway.

  • On Monday night at the Otay Mesa Port of Entry, 59-year-old Humberto Chavarria-Cervantes allegedly sped past a directed secondary inspection and reversed toward CBP officers when blocked.
  • CBP Officers Richard Labak, Jerald Talob and Hugo Osuna discharged their firearms, striking the vehicle’s windshield; none of the officers were injured and Chavarria-Cervantes suffered minor cuts from flying glass.
  • Chavarria-Cervantes surrendered at the scene and later told investigators he did not intend to hit any officers during his attempt to flee.
  • Federal court filings state officers observed a knife in the vehicle, a contraband-detection device flagged unusually high readings from the dashboard and Chavarria-Cervantes tested positive for methamphetamine.
  • Federal prosecutors have charged him with assaulting, resisting or impeding a federal officer as San Diego Police and HSI pursue separate external, criminal and administrative investigations.
