Overview
- On Monday night at the Otay Mesa Port of Entry, 59-year-old Humberto Chavarria-Cervantes allegedly sped past a directed secondary inspection and reversed toward CBP officers when blocked.
- CBP Officers Richard Labak, Jerald Talob and Hugo Osuna discharged their firearms, striking the vehicle’s windshield; none of the officers were injured and Chavarria-Cervantes suffered minor cuts from flying glass.
- Chavarria-Cervantes surrendered at the scene and later told investigators he did not intend to hit any officers during his attempt to flee.
- Federal court filings state officers observed a knife in the vehicle, a contraband-detection device flagged unusually high readings from the dashboard and Chavarria-Cervantes tested positive for methamphetamine.
- Federal prosecutors have charged him with assaulting, resisting or impeding a federal officer as San Diego Police and HSI pursue separate external, criminal and administrative investigations.
