Oregon Sues to Halt Guard Federalization as ICE Patrols Expand in Chicago

State and city leaders argue the deployments exceed federal authority under Posse Comitatus and 10 U.S.C. §12406.

Overview

  • The Pentagon notified Gov. Tina Kotek that 200 Oregon National Guard members will be placed under federal control for 60 days to protect ICE and other federal property in Portland.
  • Oregon and the city of Portland filed a federal lawsuit seeking a temporary restraining order, asserting the president lacks authority to federalize the Guard for this purpose and citing Posse Comitatus concerns.
  • Illinois Gov. J.B. Pritzker said DHS asked the Defense Department for about 100 troops to guard ICE facilities as armed Border Patrol and ICE agents carried out visible downtown Chicago patrols and arrests.
  • Attorney General Pam Bondi issued a directive for DOJ components, including the FBI, Marshals, DEA and ATF, to deploy agents to defend ICE facilities in Chicago and Portland.
  • Protests at ICE sites in Broadview, Illinois, and Portland produced clashes, arrests and the use of pepper balls and tear gas, and DHS reported seizing two guns and a potential explosive device.
