Ontario Coroner’s Report Finds Safeguard Lapses in MAiD Cases Involving Dementia

The review details practices that leave cognitively impaired patients insufficiently protected.

Overview

  • The Ontario Chief Coroner’s MAiD Death Review Committee released a dementia-focused report this week based on selected provincial case reviews from 2023–2024.
  • Only 13.6% of people with dementia who died through MAiD had received palliative care beforehand, the report found.
  • Case summaries describe single-visit capacity and eligibility assessments, MAiD provided during acute illness or delirium, and referrals initiated by family members.
  • The reviews include use of waivers of final consent without clear re-engagement and inconsistent Track 1 versus Track 2 classification that can permit same-day procedures.
  • Ontario data cited 103 MAiD deaths with dementia as the primary condition in 2023–2024, and the UN disability rights committee in March 2025 found Canada’s regime discriminatory.
