Overview
- The Congress of Oaxaca approved a new offense targeting AI use to fabricate or alter intimate images, audio or video and to share that material without consent.
- Oaxaca set penalties at four to eight years in prison and fines of 1,000–2,000 UMA, roughly 115,000–230,000 pesos at 2024 values.
- Oaxaca also created Article 72 Bis to treat AI use as an aggravating factor across crimes and added a dedicated chapter on artificial intelligence for sentencing guidance.
- In the State of Mexico, lawmakers passed penalties of up to five years in prison and up to 500 UMA in fines (about 56,570 pesos) for generating or distributing sexual deepfakes, an initiative promoted by PRI legislator Lilia Urbina Salazar.
- Separately, a PVEM deputy proposed a federal reform to punish AI‑produced child sexual abuse material with seven to 12 years in prison and 800 to 2,000 days fine, a bill sent to the Justice Commission.
