NSW Court Orders Keli Lane to Redraft Prison-Abuse Lawsuit by September 25

Her claim links alleged custodial failures to the Wayne Astill sexual abuse scandal.

Overview

  • Justice Peter Garling found the current pleadings incomplete and directed clearer particulars of the alleged duties and abuses.
  • Lane is suing 13 current and former corrective services staff, with the State of NSW expected to be added, creating the prospect of differing defences.
  • The amended filing must particularise alleged misfeasance in public office, false imprisonment and trespass to the person, as well as the damages sought.
  • Once lodged, defendants and the state will have three weeks to object to the case layout, and the matter is listed to return on October 31.
  • The claim seeks $2 million and names former commissioner Peter Severin, who died in August, among the defendants over alleged duty-of-care failures.
