November Holiday Pay Clarified in Mexico and Peru

Officials specify which November dates trigger triple pay versus regular pay.

Overview

  • In Mexico, November 1 and 2 are not mandatory rest days under the Federal Labor Law, so triple pay does not apply on those dates.
  • Because November 2 falls on a Sunday this year, Mexican workers who labor that day are entitled to at least a 25% Sunday premium per Article 71 of the LFT.
  • Mexico’s only statutory November holiday is Monday, November 17, observed for the Revolution; those who work that day must receive triple pay as prescribed by Articles 74 and 75.
  • Peru recognizes November 1 as a national holiday, and workers who labor without a compensatory rest are entitled to up to triple remuneration under Decreto Legislativo N.º 713, with Sunafil reminding employees they can file complaints for nonpayment.
  • Abancay in Peru will observe Monday, November 3 as a regional non-working day per Law N.º 15237, applying to the public sector and optionally to private employers, with local schools suspending classes and planning recovery of instructional hours.
