Nonbinary Florida Teacher Sues State Over 'Don't Say Gay' Law

The lawsuit, which includes two other LGBTQ+ teachers, argues the law banning chosen pronouns and titles in schools violates federal laws and constitutional rights.

  • AV Schwandes, a nonbinary teacher in Florida, has filed a lawsuit against the state after being fired for using the gender-neutral honorific 'Mx.'
  • The lawsuit also includes two other plaintiffs, both transgender women, who fear losing their jobs due to a state law barring teachers from using chosen titles and pronouns.
  • The law, known as the 'Don't Say Gay' law, was expanded in May to ban the use of chosen pronouns and titles in public K-12 schools.
  • The plaintiffs argue that the law violates Title VII of the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, the Fourteenth Amendment’s equal protection clause and the First Amendment’s protections on freedom of speech.
  • Florida Governor Ron DeSantis, who signed the law, has been campaigning for the Republican presidential nomination partly by promoting the anti-LGBTQ+ laws he helped enact in Florida.
