Garcia is seeking sole legal and physical custody of their 4-year-old son, Matteo, with visitation rights for Chigvintsev.
Chigvintsev has responded by requesting joint legal and physical custody, as well as spousal support and coverage of his legal fees.
The couple, who married in August 2022, had a volatile relationship according to close friends.
Both parties cited irreconcilable differences as the reason for their split, with the separation date listed as the day of the arrest.
