N.H. Supreme Court Justice Pleads No Contest in Misuse-of-Position Case

The plea deal ends the case without a trial after prosecutors alleged she sought special treatment from then-Gov. Chris Sununu.

Overview

  • Under a judge-approved agreement, Anna Barbara Hantz Marconi entered a no-contest plea to misdemeanor criminal solicitation of misuse of position, will pay a $1,200 fine, and had all other charges dismissed with a stipulation the offense is not a “serious crime” for attorney-discipline purposes.
  • Prosecutors said she met with then-Governor Chris Sununu in June 2024, claimed the probe of her husband was biased, and urged a quick resolution because she had recused from important cases.
  • Attorney General John M. Formella called her conduct unlawful and unethical, saying it undermined public confidence in the justice system.
  • Her attorney said she chose the plea to avoid a high-profile trial expected to feature senior state officials as witnesses and stated she wants to move forward.
  • Geno Marconi’s separate case remains active, with felony counts of witness tampering and falsifying evidence plus related misdemeanors, and Hantz Marconi has been on administrative leave since 2024.
