Newsom Signs Law Requiring California Officials To Disclose Accepted Job Offers

Prompted by a CalMatters investigation, the measure gives the FPPC new data to spot conflicts without changing recusal standards.

Overview

  • AB 1286 requires elected officials and state appointees to report to the FPPC the date they accepted a job offer, the position, the employer’s name and address, and a description of the employer’s activities.
  • Gov. Gavin Newsom signed the measure earlier this month after it passed the Legislature without any recorded opposition.
  • Assemblymember Tasha Boerner authored the bill after FPPC Chair Adam Silver proposed the idea following CalMatters’ reporting on job negotiations by sitting lawmakers.
  • Backers say the disclosures will improve transparency and help the FPPC identify and prosecute violations tied to influencing prospective employment.
  • Existing rules still prohibit quid pro quo and require recusal for actions with a direct and significant impact on a prospective employer, while guidelines continue to allow votes affecting a broad industry.
