Newsom Signs California AB 495 to Protect Migrant Families in Care and Schools

The measure sets staggered deadlines for education agencies to adopt privacy policies limiting immigration enforcement on campuses.

Overview

  • AB 495, known as the “Plan de Preparación Familiar,” is now law and takes effect on January 1, 2026.
  • Courts may authorize temporary joint guardianship with a designated adult, the definition of eligible relatives expands to the fifth degree, and caregivers can consent to school-related medical care.
  • Local educational agencies and state preschool programs are barred from collecting immigration‑status information, from sharing student or family records with immigration officials, and from allowing enforcement access to non‑public areas.
  • The Attorney General must update school model policies by December 1, 2025; LEAs must align policies by March 1, 2026; childcare and preschool model policies are due April 1, 2026; state preschools must adopt them by July 1, 2026.
