Overview

  • Judge Casey Fitch ruled that no significant court filings had been made in Baldwin’s January lawsuit against prosecutors and law enforcement over the 2021 ‘Rust’ shooting.
  • The dismissal without prejudice allows Baldwin’s legal team a 30-day window to file a motion seeking reinstatement of the case.
  • Baldwin’s complaint accused special prosecutor Kari Morrissey, District Attorney Mary Carmack-Altwies and Santa Fe sheriff’s investigators of malicious prosecution, intentional evidence spoliation, defamation and civil-rights violations.
  • Lead attorney Luke Nikas said the actor is engaged in good-faith settlement talks and will promptly refile if negotiations are not resolved to his satisfaction.
  • Separate wrongful death and related civil claims by Halyna Hutchins’s family and other parties stemming from the fatal on-set shooting remain active in New Mexico courts.
