New Disciplinary Tribunal Issues First Suspension of Colima Judge Over Reduced Sentences

  • The Commission of Investigation of the Tribunal de Disciplina Judicial provisionally suspended a federal district judge seated in Colima for repeatedly cutting negotiated penalties in at least four abbreviated proceedings tied to firearms and drug offenses.
  • The TDJ cited breaches of Article 187, sections III and IX, of the Organic Law of the Federal Judiciary and said the judge also granted conditional-sentence benefits, creating due-process violations.
  • Appellate courts had already corrected some of the rulings, finding the sentence reductions were contrary to law.
  • The TDJ said the suspension is intended to prevent concealment or destruction of evidence, stop ongoing harmful effects, avoid obstruction of the administrative probe, and protect potentially affected persons under LGRA Article 123 and legacy CJF rules.
