Mumbai Court Grants Anticipatory Bail to Dr Lekha Pathak, Calls Adik Pension Row a Civil Dispute

The judge directed that the investigation proceed without taking the 79-year-old doctor into custody.

Overview

  • Additional Sessions Judge Avinash P. Kulkarni found no evidence of criminal intent and said the dispute concerns civil entitlement to a widow’s pension.
  • The FIR was registered by Marine Drive police on a magistrate’s directions after a complaint by Ramrao Adik’s son, Prithviraj, alleging forgery and ineligibility under the pension law.
  • The court said Pathak does not require custodial interrogation, noted her cooperation and age, and recorded that all relevant documents are already with police while it is undisputed she has been drawing the pension as Adik’s wedded wife.
  • The order noted earlier records in which Shobha Ramrao Adik identified Pathak as Ramrao Adik’s wife, leaving any determination of legal marital status to civil proceedings.
  • Bail terms include a Rs 15,000 personal bond with one surety and weekly Tuesday reporting to Marine Drive Police for three months or until the chargesheet is filed.
