Morena Deputy Files Bill for Paid Birthday Leave or Double Pay in Mexico

The proposal seeks to add Article 74 Bis to the Federal Labor Law, with congressional approval and official publication still required.

Overview

  • Workers would be able to take their birthday as a paid day off or choose to work for an additional double payment.
  • Employees would need to notify their employer at least 15 business days in advance, except in duly justified force majeure cases.
  • The benefit would apply after six continuous months of service, with a proportional paid permit for those with less tenure.
  • An unjustified refusal by an employer to grant the benefit would constitute an infraction subject to sanctions under labor law.
  • The initiative, introduced by Morena deputy Armando Corona Arvizu, is under analysis in Congress and is not yet law.
