Moraes Votes to Reject Bolsonaro’s Clarifying Appeals in STF Virtual Review

A weeklong virtual session through Nov. 14 will determine if the convictions stand without changes, a step that could permit execution of sentences.

  • Relator Alexandre de Moraes cast the first vote to deny embargos de declaração from Jair Bolsonaro and six co-defendants, sustaining the First Panel’s September convictions.
  • The remaining votes from Cármen Lúcia, Cristiano Zanin and Flávio Dino will be recorded through Nov. 14, while Luiz Fux is not participating after his transfer to the Second Panel.
  • Defense filings challenged Bolsonaro’s alleged leadership role, the use of Mauro Cid’s cooperation, due-process issues over evidence volume, penalty calculations and overlap of crimes, arguments Moraes rejected in detail.
  • Moraes also removed from the case file a request from the Federal District penitentiary authority for a medical exam linked to a potential transfer to Papuda, citing lack of pertinence at this phase.
  • Sentence execution has not begun and could proceed after remedies are exhausted or earlier if new filings are deemed dilatory, as Bolsonaro remains under provisional home detention in a separate investigation.
