Moraes Replaces Pretrial Jail With Strict Controls for Jan. 8 Defendants

He said the close of evidence-taking removed the need to keep them in custody.

Overview

  • STF Minister Alexandre de Moraes revoked preventive detention for Alexsandra Aparecida da Silva and granted provisional release with electronic monitoring, night and weekend home confinement, weekly check-ins, a social media ban, and passport surrender.
  • Prosecutor General Paulo Gonet had opposed Alexsandra’s release, arguing the defense offered no formal medical diagnosis and warning of flight risk, but Moraes found no concrete risk of reoffending in the current record.
  • Moraes also lifted the pretrial detention of Glaudiston da Silva Cabral under similar restrictions, after previously denying a release request in late September.
  • Both defendants remain charged with criminal association and incitement tied to the Jan. 8, 2023 unrest, and Moraes warned that any breach of conditions will trigger immediate re-arrest.
  • In a separate ruling published early Thursday, Moraes restored provisional freedom to Divanio Natal Gonçalves after finding a court communication error had wrongly signaled noncompliance with his precautions.
