Moraes Rejects Bolsonaro’s Home Confinement Bid, Orders Return to Federal Police Custody After Discharge

The justice found no new medical grounds to alter custody, ruling that all prescribed treatments can be provided within the Federal Police facility.

Overview

  • Doctors report clinical stability after an endoscopy and forecast hospital discharge for Thursday, with Bolsonaro to be taken back to Federal Police custody once cleared.
  • Bolsonaro’s lawyers filed a new petition on Wednesday citing health risks and also asked that he remain hospitalized until a ruling, but the requests were denied.
  • Moraes wrote that medical reports show improvement rather than aggravation and noted 24-hour medical coverage and authorized access for his physicians, physiotherapy, medications and food at the PF unit.
  • During the nine-day stay, he underwent bilateral inguinal hernia repair on December 25, multiple phrenic-nerve blocks to temper persistent hiccups, an endoscopy showing esophagitis and gastritis, and treatment for severe obstructive sleep apnea with CPAP, with antidepressants initiated.
  • Bolsonaro has been detained since November to serve a 27-year, three-month sentence for attempting to overturn the 2022 election, and the PF will handle his transfer after the hospital release.
