Moraes Freezes Gayer Case and Sets Tight Rules for Bolsonaro Visits

The orders apply a new House resolution and enforce contact bans tied to January 8 investigations, with Eduardo Bolsonaro’s defense now seeking rejection of a PGR complaint.

Overview

  • Alexandre de Moraes suspended the criminal case against Deputy Gustavo Gayer by applying the Chamber’s Resolution No. 30/2025, pausing charges of calumny, defamation and insult until the end of his mandate and tolling prescription from October 15.
  • Moraes again denied Gayer permission to visit Jair Bolsonaro, citing the July 17 precaution that forbids Bolsonaro from communicating with defendants or investigated individuals and noting Gayer is under investigation in PET 12.042.
  • The minister authorized visits to Bolsonaro by Altineu Côrtes, Alberto Fraga, Nelson Piquet and journalist Alexandre Pitolli on November 3–6 under strict conditions, including 10 a.m.–6 p.m. windows, no phones or recordings, and vehicle searches.
  • Bolsonaro remains under preventive house arrest imposed on August 4 over suspected coercion and obstruction in related probes, with appeals in his 27-year, 3-month conviction slated for review by the STF First Chamber from November 7 to 14.
  • The Public Defender’s Office filed a preliminary defense on October 31 asking the STF to reject the PGR’s complaint against Eduardo Bolsonaro, arguing lack of specific intent and procedural flaws after Moraes refused notification by letter rogatory and ordered the DPU to represent him.
