Overview

  • The proposal would amend articles 215 and 419 of the General Health Law and introduce article 216 Ter to prohibit the sale, distribution and promotion of energy drinks to anyone under 18.
  • Energy drinks are legally defined as nonalcoholic beverages containing stimulants such as caffeine, taurine, glucuronolactone, guaraná, ginseng and B-group vitamins.
  • Violators of the under-18 ban would face fines up to 2,000 UMAs, equivalent to 226,280 pesos, for each infraction.
  • The Health Commission is currently analyzing the bill ahead of its September 1 floor debate while producers of energy drinks intensify lobbying efforts.
  • Lawmakers cite WHO, UNICEF and Profeco data on rising youth consumption and documented cardiovascular and neurological harms to justify stricter regulation.
