Missouri AG Seeks Partial Summary Judgment to Oust St. Louis Sheriff Alfred Montgomery

The filing asks the court to rule now on three misconduct counts the state says rest on uncontested facts.

Overview

  • Attorney General Catherine Hanaway filed a motion on Oct. 7 for partial summary judgment in the quo warranto case seeking Montgomery’s removal from office.
  • The motion targets three counts: allegedly ordering the unlawful detention of Deputy Commissioner Tammy Ross, failing to provide required medical transports for detainees more than 60 times, and using on‑duty deputies and taxpayer vehicles to transport and supervise his children.
  • Hanaway said the undisputed record shows Montgomery forfeited the right to hold public office and asked the court to enter judgment without a trial on those counts.
  • The state first demanded Montgomery’s resignation in June and then filed a 90‑page quo warranto petition outlining six alleged misconduct counts, after which the court ordered a response.
  • Hanaway also flagged alleged discovery noncooperation in posts referencing the Missouri Supreme Court, while Montgomery continues to face a federal indictment and a separate local dispute over inmate‑transport authority.
