Overview
- The Ministry of Energy and Mines published a draft supreme decree on Sept. 29, 2026 that creates the Declaración Jurada Ambiental para Exploración Minera and opened a 15-calendar-day public consultation.
- The new instrument targets exploration projects judged to have non‑significant impacts and limits eligibility to projects with up to 10 drilling platforms and a surface area under the threshold set in the draft (reported as under 5 hectares).
- Under the proposal the Dirección General de Asuntos Ambientales Mineros would issue a Constancia de Aprobación Automática within five business days of a DJA filing, while the SEIA would remain the broader system for impact assessment.
- The Organismo de Evaluación y Fiscalización Ambiental would keep supervisory and enforcement authority, and the draft includes public participation steps such as workshops plus written submissions to DGAAM in San Borja or by email.
- If adopted the measure could shorten timelines for small exploration campaigns and speed drilling work, but it is not yet in force and the consultation will shape whether and how the fast‑track path is implemented.
