Michigan AG Seeks Rehearing on DTE Power Contracts for 1.4-GW AI Data Center

DTE faces a Jan. 17 deadline to accept conditions after the commission’s ex parte approval.

Overview

  • Attorney General Dana Nessel filed a 30-page rehearing petition arguing the Michigan Public Service Commission relied on vague, unenforceable assurances and urging a contested case to review the redacted contracts.
  • A separate 27-page filing from the Michigan Environmental Council, NRDC, Sierra Club, and Citizens Utility Board seeks clearer enforcement language and questions the legal basis for skipping a contested case.
  • The MPSC conditionally approved DTE’s special contracts on Dec. 18 and denied a contested hearing, requiring DTE to formally accept the order’s conditions by Jan. 17.
  • DTE says the agreements protect customers from subsidizing data center rates and from stranded-asset risk, citing its obligation to serve large-load customers.
  • The project, developed by Related Digital for Oracle and OpenAI in Saline Township, would draw about 1.4 gigawatts and require major grid investments, with the next MPSC meeting set for Jan. 15 and potential appeals preserved.
