The accident occurred on Feb. 6 as Pino was assisting a stranded motorist; Highsmith was reportedly speeding and cited for careless driving.
Pino is seeking unspecified damages in excess of $50,000, with his family also setting up a GoFundMe page to aid his recovery.
Highsmith's agent claims the player attempted to assist the victim immediately after the crash, staying until first responders arrived.
