Miami Break-In Suspect Faces Charge Upgrade After Alleged Assault on Sleeping Resident

A judge found probable cause for a harsher count following prosecutors’ depiction of the conduct as egregious.

Overview

  • Police say the intruder entered a Miami apartment around 4 a.m., touched the sleeping occupant over his clothing, exposed himself, urinated on the victim, said “I know you,” and fled.
  • Officers canvassed the area, the victim provided a description, and 34-year-old Maykel Rodriguez Jr. was located nearby, positively identified, and arrested.
  • Rodriguez initially faced charges of burglary of an occupied dwelling, battery, and indecent exposure, and the court found probable cause to upgrade to burglary with assault or battery.
  • Prosecutor Nessa Eth called the allegations “pretty egregious,” and authorities indicated they would pursue the upgraded charge.
  • Defense counsel said Rodriguez served five years in the U.S. Air Force and requested bond, with a further court hearing set for Tuesday, Dec. 30.
