Mexico's Supreme Court Takes IMSS Retirees' Savings Case After 7–2 Vote

The case could prompt the justices to revisit a 2008 ruling that has blocked the return of ‘cesantía’ balances to former workers.

Overview

  • The full court exercised its facultad de atracción to hear a direct amparo from retirees seeking repayment of funds in the ‘cesantía en edad avanzada y vejez’ subaccount under the 1973 Social Security law.
  • The measure passed 7–2, with Justices Yasmín Esquivel Mossa and María Estela Ríos González in dissent.
  • The matter reached the high court via referral from the Primer Tribunal Colegiado del Vigésimo Quinto Circuito, and it now enters study with no ruling on the merits.
  • Retirees organized as Movimiento Jubilados Pie de Lucha protested on September 22 and later met with Chief Justice Hugo Aguilar Ortiz and other ministers.
  • In the same session held at an alternate venue, the court also attracted cases on transgender health treatments in Jalisco, legal gender recognition procedures in Aguascalientes, and weekly check-in requirements for asylum seekers.
