Mexico's Supreme Court Rejects Bid to Limit Environmental Amparos

The justices said there was no contradiction of criteria, leaving the dispute to regional plenary courts.

Overview

  • The Supreme Court plenary voted 7–2 to dismiss Minister Yasmín Esquivel’s project without reaching the substance of her proposal.
  • Only Esquivel and Minister Sara Herrerías supported finding a contradiction of criteria that would have allowed the case to proceed.
  • Esquivel’s draft argued that an association’s corporate purpose is insufficient to prove legitimate interest and pressed for proof such as using or living in the affected area.
  • Ministers including Court president Hugo Aguilar Ortiz, Giovanni Figueroa Mejía and Arístides Guerrero García argued that any conflict should be resolved by the Regional Plenary Courts.
  • Environmental and human-rights groups, including Greenpeace, Centro Pro, Fundar, CEMDA and Artículo 19, warned the proposal would restrict access to amparo as recent reforms tightened standing requirements.
