Mexico’s Supreme Court Publishes 104-Participant List for Disability Consultation Hearings

The sessions respond to a contested draft that would curb the Court’s ability to void laws passed without consulting people with disabilities.

Overview

  • The SCJN posted the names of 104 individuals and organizations selected from more than 300 registrants for public hearings set for October 20–22 from noon to 4 p.m.
  • The Plenary extended the dialogue to three days to hear all selected participants and said it will implement accessibility measures and reasonable adjustments.
  • The hearings precede a ruling in Acción de Inconstitucionalidad 182/2024 concerning Michoacán’s human rights law and the standard for invalidating norms for lack of consultation.
  • Minister Lenia Batres’s draft would abandon the established consultation criterion and prevent invalidation where norms are deemed to “benefit” people with disabilities without defining that concept, while also narrowing who may challenge.
  • More than 700 groups have urged the Court to uphold consultation in line with the CRPD, as Minister Yasmín Esquivel publicly defended the right, with activists also noting delays and accessibility concerns in the selection process.
