Mexico’s Supreme Court Orders Elektra to Pay 33.3 Billion Pesos in Tax Dispute

The decision ends years of delay tactics, enabling enforcement on additional cases that courts place at about 48 billion pesos.

Overview

  • By unanimous vote, the SCJN dismissed Elektra’s amparo 6321/2024, making final a ruling that requires payment of 33,306,476,349 pesos for a 2013 income tax credit, with updates, surcharges and fines.
  • The justices also resolved or advanced multiple Elektra and TV Azteca matters, with combined liabilities reported around 48,000 to 48,393 million pesos covering tax years from 2008 to 2015.
  • The Court rejected attempts to recuse ministers Lenia Batres and Yasmín Esquivel and sanctioned Grupo Salinas for filings deemed to delay the administration of justice.
  • Case records and media tallies show the conglomerate lodged more than 100 legal resources over several years to postpone final judgments, while the Court’s president refused further postponements.
  • Grupo Salinas condemned the rulings as politically motivated and said it will seek international avenues, as President Claudia Sheinbaum emphasized respect for judicial independence and the rule of law.
