Mexico’s Supreme Court Dismisses Key Grupo Salinas Appeal, Clearing Way for 33 Billion-Peso Tax Bill

The justices opened a plenary push to settle seven long-disputed fiscal cases that could cement tens of billions of pesos in credits for the tax authority.

Overview

  • By unanimous vote, the Court threw out amparo en revisión 6321/2024 tied to a 2013 income tax credit originally near 18 billion pesos that updated could exceed 33 billion, with authorities to determine the final amount.
  • The plenary is taking up additional Elektra and TV Azteca cases whose outcomes, if confirmed, would finalize tribunal rulings totaling roughly 40 to 48 billion pesos in taxes, surcharges and fines.
  • Ministers rejected last-minute bids by Grupo Salinas to delay proceedings and to disqualify all nine justices, and they imposed sanctions for filings deemed to hinder or stall the cases.
  • Court president Hugo Aguilar Ortiz noted the matter had been extensively litigated with dozens of resources, as the session continued from an alternate venue to dispose of the long-pending docket.
  • President Claudia Sheinbaum said her government will await and respect the Court’s decisions, while Grupo Salinas denounced the process as politicized and signaled continued challenges.
