Mexico’s Supreme Court Dismisses Final Challenge to INE Chief’s Expanded Powers

The court said electoral rules must be challenged through actions of unconstitutionality, citing a 2025 precedent.

Overview

  • In a 6–3 vote, the plenary adopted Justice María Estela Ríos’s proposal to dismiss the constitutional controversy filed by Claudia Edith Suárez, acting head of the INE’s Secretariat.
  • The majority held that the dispute falls under electoral matters that cannot be pursued via controversia constitucional and referenced prior rulings from February 2025.
  • The challenged 2024 amendments to LGIPE articles 45 and 48 allow INE president Guadalupe Taddeí to appoint executive directors and authorize the Junta General Ejecutiva to approve operational coordination agreements.
  • Justices Loretta Ortiz, Lenia Batres and Giovanni Figueroa dissented, calling for a merits review and warning of potential harm to the INE’s constitutional autonomy.
  • With no further Supreme Court challenges pending, the expanded authorities remain in effect and have already been used, according to earlier reports.
