Mexico’s Rest-Day Pay Rules Explained as Bill Seeks New May Holiday

A Morena proposal would recognize the first Monday of May as a compulsory day off under a law that has not added new holidays since 1987.

Overview

  • Workers are entitled to at least one paid rest day for every six days worked, and employers cannot require them to work on that day.
  • If an employee agrees to work on a weekly rest day, the employer must pay the regular daily wage plus an equal amount; on a mandatory holiday, the total effectively equals triple pay.
  • For November’s long weekend, the statutory day off is Monday, Nov. 17 for Revolution Day, and those who work that day must receive the holiday rate.
  • Deputy Carlos Ignacio Mier Bañuelos filed a bill to add the first Monday of May as a mandatory holiday in the Federal Labor Law, and the proposal is in the legislative process.
  • Labor authorities STPS and PROFEDET provide free guidance and take complaints about nonpayment, with violations subject to fines of roughly 5,675 to 565,700 pesos.
