Mexico’s Chamber of Deputies Backs Harsher Penalties for Property Despojo, Sends Bill to Senate

The vote responds to a surge in property dispossession complaints nationwide.

Overview

  • Lawmakers unanimously approved the reform 413–0 to amend Federal Penal Code Article 395, setting prison terms of six to ten years and fines of 500 to 2,000 UMAs for despojo.
  • Penalties rise by up to one half when victims are older adults, people with disabilities or otherwise vulnerable, or when public servants are involved, reaching up to 15 years.
  • The reform expands punishable conduct to include unlawful occupation by an owner when the property is in another person’s lawful possession and increases penalties for the dispossession of water.
