Overview

  • Article 87 of the Federal Labor Law guarantees at least 15 days of pay as an annual aguinaldo due no later than December 20, with a proportional amount for those who did not work the full year.
  • For fixed salaries, calculate daily pay by dividing the monthly salary by 30 and multiply by 15; for variable pay, use the average of the last 30 days, counting vacation, maternity or paternity leave, weekly rest days and work‑risk incapacity.
  • If the employment relationship ended before December 20, the proportional aguinaldo must be included in the final settlement, and the benefit must be paid in cash or bank transfer rather than in kind or vouchers.
  • BBVA offers an online simulator that estimates the full or proportional aguinaldo based on start date, last day worked and current monthly income.
  • Workers can file complaints with PROFEDET for nonpayment or underpayment, domestic workers are fully entitled to this benefit, and claims may be pursued for up to one year after December 20.
