Mexico Weighs Making Workers’ Birthdays a Mandated Paid Day Off

Filed in January, the proposal remains in committee with advance notice requirements alongside a minimum tenure condition.

Overview

  • Morena deputy Armando Corona Arvizu introduced an initiative to add Article 74 Bis to the Federal Labor Law to recognize employee birthdays as a mandatory paid rest day.
  • Under the draft, each worker could choose to take the day off with pay or work the date for additional compensation, reported as double pay.
  • Eligibility would start after six months of service, and employees would need to notify employers at least 15 days in advance of how they intend to use the benefit.
  • The initiative was turned to commissions in the Chamber of Deputies and must still clear a Plenary vote, Senate review and Executive promulgation before it could take effect.
  • Current law sets specific mandatory rest days that trigger triple pay if worked under Profedet guidance, situating the birthday-leave plan within a broader push since 2025 to add rest days.
