Mexico Sets 2026 Rules for App Workers’ Social Security Access With Vehicle-Based Income Thresholds

Unions warn the new formula will leave most platform workers without full IMSS protections.

Overview

  • STPS published an agreement in the federal gazette setting revised exclusion factors for 2026 to determine which delivery drivers and drivers qualify for IMSS.
  • Gross monthly income now counts payments for tasks, bonuses, gratifications and incentives, while tips are excluded from the contribution base.
  • To reach the net minimum tied to 2026 wages, workers must generate about 18,427.83 pesos if using a car (48% exclusion), 14,092.46 with a motorcycle (32%) or 9,878.83 without a motor (3%).
  • Only workers who exceed the thresholds enter IMSS’s mandatory regime with five-branch coverage; those below are treated as independent with work-risk insurance only.
  • STPS says just 14.12% accessed full benefits in the pilot and plans tougher oversight in 2026, as unions and a legal analyst argue the thresholds create a technical barrier that could exclude most workers.
